Our First Sweepstakes

 

Official Rules

 

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. SEE SECTION 5 FOR FREE ENTRY.  

 

VALID E-MAIL ADDRESS REQUIRED.

 

1)     Sponsor:  Gem Mint Collectors LLC, Orange Park, Florida  32073 (“Sponsor”). BY PARTICIPATING IN THE SWEEPSTAKES, YOU AGREE TO ABIDE BY AND BE BOUND BY THESE OFFICIAL RULES AND SPONSOR’S DECISIONS WHICH ARE FINAL AND BINDING IN ALL RESPECTS AND ARE NOT SUBJECT TO APPEAL.

 

2)    Eligibility: Open only to legal residents of the (50) United States[SS1]  or the District of Columbia, 18 years of age or older.  The following persons are not eligible to enter the Sweepstakes or win the prize:  employees, officers and directors of Sponsor, its parent company, subsidiaries, divisions and affiliated companies or other organizations in any way involved with the  development, design, production or conduct of the Sweepstakes as well as members of the immediate family† or same household of such employees/officers/directors.

† Immediate family is defined as parent, sibling, spouse or child.

 

3)    Sweepstakes Period: Sweepstakes starts October 1, 2026 at 12:00 a.m. Eastern Time and ends November 15, 2026 at 11:59:59 p.m. Eastern Time (“Sweepstakes Period”).  Sponsor’s computer is the official clock for all purposes of the Sweepstakes.

 

4)   How To Enter- Online Purchase:

 

(a)              Visit Sponsor’s website at WinGemMint.com (“Sweepstakes Website”). For each dollar spent on the purchase price of products on the Sweepstakes Website, you will receive one (1) Entry PROVIDED THAT YOU CHECK THE BOX INDICATING THAT YOU ARE A LEGAL U.S. RESIDENT WHO IS 18 YEARS OF AGE AND YOU AGREE TO THESE OFFICIAL RULES. (IF THIS BOX IS NOT CHECKED, YOU WILL NOT RECEIVE ANY ENTRIES IN CONJUNCTION WITH PRODUCT PURCHASE.) No Entries will be received for dollars spent on taxes and shipping charges.     

(b)              Sponsor will round up dollars spent in providing Entries. To illustrate, if you spend $25.75 to purchase a T-shirt on Sweepstakes Website, you will receive 26 Entries. 

(c)               Sponsor will provide Entries AFTER deducting any coupons, rebates or other discounts. To illustrate, if you purchase a hat for $17.00 on Sweepstakes Website but redeem a $2.00 coupon on the purchase, you will receive 15 entries (not 17 entries.)

(d)              If, prior to the random drawing (see Section 6 below), purchased product is returned for a refund, all corresponding Entries will be voided and rescinded. If, prior to the random drawing, purchased product is exchanged for another product, the number of Entries received will be modified to reflect the purchase price of the product for which the originally purchased product was exchanged.

(e)             In all cases, the purchaser of the item will be provided Entries even if a purchase is a gift for someone else. Sponsor will resolve any disputes as to identity of entrant in its sole discretion.

(f)              Acknowledgment that Entries have been provided (including, without limitation, proof of purchase) is not otherwise binding upon Sponsor under any legal theory.

(g)             If purchase is made via compatible mobile device, the purchaser will be solely responsible for any wireless carrier charges and other fees incurred in conjunction therewith. No Entries will be provided in connection with wireless carrier charges/fees.

 

 

5)    HOW TO ENTER FOR FREE – ALTERNATE METHOD OF ENTRY:

 

(a)  Hand print you name, address, e-mail address (REQUIRED), and year of birth on a 3”x 5” card and mail in a business-size (#10) envelope to: 950-23 Blanding Blvd #313 Orange Park, FL 32073(“Mail-In Entry”). 

(b)  Mail-In Entry must be postmarked by November 1, 2026 and received by November 8, 2026.

(c)    Each eligible Mail-In Entry will count for 1 (one) Entries in the random drawing[SS2] .

(d)   If submitting more than one (1) Mail-In Entry, each Mail-In Entry must be mailed separately.

(e)  Mail-In Entry will only be accepted if it is (i) mailed from an address in the (50) United States or Washington, DC and (ii) NOT copied or mechanically reproduced.

(f)    Receipt of Mail-In Entry will not be acknowledged. Mail-In Entries become the sole property of Sponsor.

(g)  Proof of mailing/submitting Mail-In Entry does not constitute proof of receipt of same or proof of entering the Sweepstakes. 

 

6)   RANDOM DRAWING:  The potential winner will be selected in a random drawing from among all eligible Entries (that is, Mail-In Entries and Entries) received.  The random drawing will be conducted by an independent third party[SS3]  on or about October 31, 2026. 

 

7)    WINNER NOTIFICATION:  The potential winner will be notified via e-mail on or about November 14, 2026. The potential winner will be disqualified if (a) Sponsor cannot contact potential winner notwithstanding its commercially reasonable efforts to do so (including, without limitation, if e-mail notification to potential winner is returned as undeliverable or delayed for any reason); (b) he/she/they fails to return the completed and signed Affidavit of Eligibility, Liability Release and Publicity Release[SS4]  within five (5) days of date of notification; or (c) he/she/they DOES timely return the completed and signed Affidavit of Eligibility, Liability Release and Publicity Release but Sponsor determines that the potential winner is not eligible for the Sweepstakes or is otherwise in violation of these Official Rules. Should Sponsor disqualify potential winner, the prize will be forfeited without liability of any kind to Sponsor; and, Sponsor will select an alternate potential winner from among all remaining eligible Entries received for the random drawing as per Section 6 above.

 

8)   PRIZE & ODDS: The prize is a graded Gem 10 Charizard‡ card. 2021 Pokemon Celebrations #4 (4/102) Charizard – Holo Classic Coll – Base Set – PSA 10. Value for card ~$550

 

‡No sponsorship, endorsement, authorization or affiliation of any kind is intended or implied by such use. Trademark is used solely to describe the prize.

 

(a)  Approximate Retail Value does NOT represent re-sale value of prize. SPONSOR MAKES NO WARRANTY, REPRESENTATION OR GUARANTEE THAT THE VERIFIED WINNER WILL BE ABLE TO RE-SELL THE PRIZE FOR THE STATED APPROXIMATE RETAIL VALUE ON THE SECONDARY MARKET AS THE VALUATION OF TRADING CARDS IS DEPENDENT ON MARKET FLUCTUATIONS AND CONSUMER SUPPLY AND DEMAND.

(b)  TO THE FULLEST EXTENT PERMITTED BY LAW, THE PRIZE IS AWARDED “AS IS.” SPONSOR MAKES NO REPRESNTATION, WARRANTY OR GUARANTEE OF ANY KIND ON THE PRIZE (INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR THE INTENDED PURPOSE).

(c)   Verified winner is solely responsible for any and all expenses in conjunction with acceptance and use of prize, including any desired insurance on prize and costs related to display or safeguarding of prize.

(d)  Verified winner is solely responsible for any and all taxes on the value of the prize.  In accordance with Internal Revenue Service requirements, Sponsor will issue verified winner an IRS 1099 Tax Form for the value of the prize. Verified winner agrees to fully cooperate with Sponsor in conjunction with Sponsor’s issuance of the IRS 1099 Tax Form (as well as Sponsor’s compliance with any other governmental tax reporting requirements) including by providing his/her/their Social Security Number or Tax Identification Number to Sponsor on an IRS W-9 Tax Form.  

(e)  Prize will be awarded to verified winner at a street address in the  (50) United States or Washington, DC  __1_ - _3___ weeks after completion of the verification procedure.

(f)    Prize will only be released to verified winner upon provision of valid government-issued photo identification (for example, driver’s license.)

(g)  Prize is not transferable by verified winner. Prize cannot be redeemed or exchanged for cash by verified winner.

(h)  No prize substitution except by Sponsor in its sole discretion due to prize unavailability for any reason and only then for prize of comparable value.

(i)    Actual prize may differ from images of same on Sweepstakes Website or in advertising material in support of the Sweepstakes, with Sponsor disclaiming any and all liability in conjunction therewith.

(j)    There is a limit of one (1) prize in any sweepstakes or contest promotion offered by Sponsor during a given six (6) month period.

(k)                        By accepting prize, where legal, winner grants to Sponsor and its designees the right to use his/her/their name, image, likeness, publicly available biographical information, and other indicia of his/her/their persona for advertising and trade purposes without further compensation or notice of any kind. Nothing herein in any way obligates Sponsor to proceed with such use and, by refraining from doing so, Sponsor will not incur any liability under any legal theory.

(l)  Odds of winning the prize depend on the total number of eligible Entries received during the Sweepstakes Period.

 

9)   GENERAL CONDITIONS:

 

(a)  Sponsor disclaims any and all liability in conjunction with programming, technological, electronic or other error, failure or malfunction of any kind which in any way interferes with, interrupts or impedes the intended operation of the Sweepstakes, including, without limitation, any error/failure/malfunction which impedes, interrupts or prevents Sponsor from recording Entries associated with product purchases on Sweepstakes Website or Sponsor’s ability to contact the potential winner. Further, Sponsor is not responsible for (i) Entries or Mail-In Entries that, as applicable, are lost, late, delayed, stolen, inaccessible, corrupted, jumbled, misdirected, damaged, illegible, garbled, incomplete, postage due or otherwise defective (all of which are void) or (ii) any damage to an entrant’s or any other person’s computer or mobile device or any information stored thereon.

(b)  By participating in the Sweepstakes, you release, indemnify and agree to hold harmless Sponsor, its parent company, affiliated companies, subsidiaries, and divisions, as well as the officers, employees, directors, representatives, shareholders, agents, successors and assigns of any of the foregoing organizations from and against any and all liability arising from participation in the Sweepstakes or the acceptance, possession, receipt, use or misuse of the prize (if applicable).

(c)   Collection and use of your personal information is subject to the Privacy Policy of Sweepstakes Website, found at WinGemMint.Com

(d)  Sponsor’s failure to enforce any provision of these Official Rules shall not constitute the waiver of such provision.

(e)  In the event of any inconsistency between these Official Rules, on the one hand, and any advertising for the Sweepstakes, on the other hand, these Official Rules will prevail, govern and control. 

(f)    Should a court of competent jurisdiction determine that any provision of these Official Rules is illegal, invalid or unenforceable, the provision in question shall be replaced with a substitute provision that best captures the original intent of Sponsor and is legal, valid and enforceable. The determination by a court of competent jurisdiction that a given provision of these Official Rules is illegal, invalid or unenforceable shall not affect the remainder of these Official Rules.

(g)  Tampering of any kind with the operation of the Sweepstakes or any attempt to defraud Sponsor relative to the Sweepstakes will result in disqualification from the Sweepstakes, prohibition from participation in future sweepstakes or contests offered by Sponsor and prize forfeiture (if applicable). Sponsor further reserves the right to pursue all available legal remedies in such case.   

 

10)  FORCE MAJEURE: Sponsor reserves the right to cancel, suspend or modify the Sweepstakes and – if feasible – award the prize from among all eligible entries received prior to and/or after the action taken by Sponsor should Sponsor determine in its sole discretion that the Sweepstakes cannot be conducted as originally planned due to an event of force majeure.• Should Sponsor take such action, Sponsor will post a notice to such effect on Sweepstakes Website.     

•An event of force majeure includes but is not limited to (a) natural cataclysm; (b) pandemic/epidemic; (c) governmental action (whether or not upheld as lawful by a court of competent jurisdiction); (d) civil commotion; (e) strike; (f) riot; (g) materials shortage; (h) act of war or insurrection; (i) computer virus or act of fraud. 

 

11)  DISPUTES & CHOICE OF LAW:

(a)  To the fullest extent permitted by law, you agree that any dispute regarding these Official Rules or the Sweepstakes itself will be governed by the internal, substantive laws of the State of Florida (that is, without regard to principles of conflict-of-laws/choice of laws of the State of Florida or of any other jurisdiction.)

(b)  You acknowledge that you are subject to the personal and exclusive jurisdiction of the U.S. District Court for the Middle District of Florida (in Jacksonville) or Florida State Court in Duval County, waiving any right of forum non conveniens, change of venue or the like. 

(c)   You further agree that (i) your recovery in any such action will be limited to your actual costs in participating in the Sweepstakes (if any), with all forms of damages (for example, consequential, compensatory, incidental or punitive damages) as well as injunctive relief or any other form of equitable relief being expressly waived; and (ii) any action will be brought by you solely on an individual basis and not as part of a class or in the capacity of a private attorney general.

 

12) WINNER’S LIST:  For the first name, last initial and city/state of the verified winner, send a self-addressed stamped envelope to 950-23  Blanding Blvd #313, Orange Park, FL, 32073 for receipt by November 1, 2026. Winner’s list will be available after November 16th, 2026.
